Lindsey Graham demands ICC reveal details of probe into prosecutor Khan’s misconduct allegations

U.S. Senator Lindsey Graham has demanded that the International Criminal Court (ICC) provide more details about the ongoing investigation into allegations of professional misconduct against Fatou Bensouda and Fergal Gaynor, both of whom were newly elected ICC Prosecutor Karim Khan's deputies during his tenure as the head of the United Nations' Investigative Team to Promote Accountability for Crimes Committed by Da’esh/ISIL (UNITAD). The allegations emerged from an external review published in December 2021, which found five allegations of professional misconduct within UNITAD to be substantiated. In absence of additional details, it is unclear whether Khan is implicated in the alleged misconducts. However, Khan's leadership of UNITAD and his subsequent election as ICC Prosecutor have been marred by these allegations. Senator Lindsey Graham, a member of the Senate's Judiciary Committee, believes the ICC owes an obligation to its member states, the United States included, to disclose more specifics about the nature of these allegations and the steps taken or to be taken. As a matter of transparency, Graham urges the ICC to disclose if the alleged misconduct could impact the integrity of the investigations and prosecutions under Khan's leadership or if they could possibly undermine the legitimacy of the Court itself.
